Bankruptcy Law
Bankruptcy and Soffan Law PC can protect you from creditors. Bankruptcy laws are designed to protect individuals and businesses that have fallen on hard times, insulating them from debt, collection calls and/or lawsuits or threatened actors. The Bankruptcy Code includes three types of bankruptcy options depending upon the need and objectives of the client.
Of initial significance is that the filing of a bankruptcy under any Chapter immediately ceases all collection activities, no more phone calls, letters of intimidations. Equally meaningful is that all the debts can be either extinguished permanently or if a family wants to keep their home, then they can fashion an enforceable payment plan requiring only minimal payments to creditors and vastly reduces amounts that will not deprive the family of its home or livelihood. Finally, each of the bankruptcy alternatives ensures the honest consumer begins a “fresh start” free of most, if not, all debts.
Chapter 7 Bankruptcy
Chapter 7 is for individuals and corporations or other entities who fallen on hard times and seek a debt free fresh start. The advantages of Chapter 7 usually include:
Discharging your unsecured debt, such as credit cards, personal loans, and deficiencies from foreclosures or repossession and certain tax debts.
Ending annoying calls from collection agencies, lawsuits, and threatening letters;Often retaining your home and cars, as long as you are current on your payments.
Provides you with a fresh start to your financial life.
Chapter 11 Bankruptcy Subchapter IV
This type of Bankruptcy is utilized mostly by businesses that suffered earlier losses but can be revitalized if given time to restructure. In Chapter 11, you continue to operate the business, but the court must approve a plan to repay a portion of your debts.
Chapter 13 Bankruptcy
Keeping your home, even if in default as long as your income can support your necessary expenditures provided you agree to pay part of your income to catch up on mortgage payments and a portion to your creditors. The court approves your repayment plan and your budget as long as your income can support your necessary expenditures.
